Consent to Telephonic Communications

This Consent to Telephonic Communications ("Consent") governs your agreement to receive telephone calls and text messages from Ridgepeak Capital, LLC ("Ridgepeak Capital," "we," "us," or "our"), including its agents, affiliates, service providers, and lending partners. By providing your telephone number(s) or contact information to Ridgepeak Capital, you acknowledge that you have read, understood, and agree to the terms set forth below.
1. Call Recording and Monitoring
You acknowledge and agree that any telephone calls placed to or received from Ridgepeak Capital, its agents, affiliates, or service providers may be monitored and/or recorded for quality assurance, training, compliance, and record-keeping purposes. By engaging in telephone communications with us, you consent to such monitoring and recording.
2. Accuracy of Contact Information
You represent and warrant that all contact information you provide to Ridgepeak Capital — including, but not limited to, your name, mailing address, email address, residential telephone number, business telephone number, and/or mobile telephone number — is true, accurate, and current at the time of submission. You further represent and warrant that you are the current subscriber or authorized user of any telephone number you provide to us.
You are prohibited from providing any telephone number that does not belong to you or for which you are not an authorized user. If we determine that any contact information you have provided is false, inaccurate, or belongs to another party, we reserve the right to suspend or terminate your account and any pending applications without prior notice.
You agree to promptly notify us of any changes to your contact information — including any change of ownership or reassignment of telephone numbers — before such change takes effect. You may notify us of changes by contacting us at [email protected] or by calling us at the number listed on our website.
3. Consent to Receive Automated Calls and Text Messages
By voluntarily providing your telephone number(s) to Ridgepeak Capital, you expressly consent to receive the following types of communications at the telephone number(s) you have provided:
(a) Calls and text messages (including SMS and MMS) using automated telephone dialing systems, artificial or prerecorded voice messages, and/or AI-generated voice or text content;
(b) Communications related to your account, any application or transaction you have submitted, promotional offers, and/or your relationship with Ridgepeak Capital;
(c) Communications from Ridgepeak Capital and from third parties acting on our behalf, including lending partners, service providers, and marketing partners.
This consent applies regardless of whether any telephone number you provide is listed on any federal, state, or local Do Not Call registry. You further agree that Ridgepeak Capital may contact you at any telephone number, email address, or mailing address you provide or that we obtain through lawful means, including but not limited to skip tracing, caller ID capture, or public records.
Your consent to receive automated communications remains in effect even if you cancel your account or your application is no longer pending, unless you affirmatively opt out as described in Section 4 below.
Your consent to receive promotional or marketing communications is entirely voluntary and is not a condition of purchasing any goods or services, submitting an application, or creating an account with Ridgepeak Capital. If you do not wish to provide consent, you may still contact us directly at [email protected] or by telephone to inquire about our products and services.
4. How to Opt Out
You may withdraw your consent to receive automated calls and/or text messages at any time. Your options for opting out are as follows:
Opting Out of Text Messages
To stop receiving text messages, reply STOP (or any substantially similar keyword such as "END," "QUIT," "CANCEL," or "UNSUBSCRIBE") to any text message you receive from us. You may also text HELP at any time for assistance. You acknowledge and agree to receive a final confirmatory text message after submitting your opt-out request.
Please note that Ridgepeak Capital may use multiple shortcodes or telephone numbers for different messaging purposes. Replying STOP to one number will only unsubscribe you from messages sent from that specific number. To opt out of messages from multiple numbers, you must reply STOP to each number individually. Alternatively, you may email [email protected] specifying the telephone number(s) for which you wish to opt out of text messages.
Opting Out of Automated Voice Calls
To opt out of automated voice calls (distinct from text messages), you must provide written notice to Ridgepeak Capital that includes: (i) your full legal name; (ii) your email address; (iii) your business name (if applicable); and (iv) the specific telephone number(s) for which you wish to revoke consent to automated calls. Send this written notice to [email protected].
General Opt-Out Provisions
It is your sole responsibility to notify us if you no longer wish to receive automated calls or text messages. Please allow up to thirty (30) days for your opt-out request to be fully processed.
Please note that even after opting out of automated communications, we reserve the right to contact you through non-automated means (e.g., manually dialed calls) regarding your account, pending applications, or other transactional matters.
Ridgepeak Capital is not responsible for communications you may continue to receive from third-party lending partners or service providers. You should contact such third parties directly to manage your communication preferences with them.
5. Message Frequency and Charges
There is no fee charged by Ridgepeak Capital for receiving automated telephone calls or text messages. However, your wireless carrier may impose standard message and data rates for calls and text messages sent to and from your device. These charges are your sole responsibility. You represent and warrant that you are authorized to incur such charges. Ridgepeak Capital is not responsible for any carrier fees or charges.
Message frequency varies. You may receive up to 15 messages per month depending on the nature of your account activity and communications preferences.
For questions about your wireless plan, data rates, or messaging fees, contact your wireless carrier directly.
6. Device Security
You are responsible for maintaining the security of your telephone device and any accounts accessible through it. You must notify Ridgepeak Capital immediately of any unauthorized access to or use of your device that could result in unauthorized receipt of communications intended for you. While Ridgepeak Capital is not liable for losses arising from unauthorized use of your device, you may be held responsible for any losses incurred by Ridgepeak Capital resulting from such unauthorized use.
7. Indemnification
You agree to indemnify, defend, and hold harmless Ridgepeak Capital, its officers, directors, employees, agents, affiliates, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
(a) Your provision of a telephone number that does not belong to you or for which you are not an authorized user;
(b) Your failure to update your contact information, including telephone numbers, in a timely manner;
(c) Any claims brought under the Telephone Consumer Protection Act (TCPA), or any equivalent state or local statute, regulation, or ordinance;
(d) Any privacy, tort, or consumer protection claims related to the telephonic communications contemplated by this Consent.
In the event of any claim covered by this indemnification provision, Ridgepeak Capital shall have the right, at your expense, to select and retain legal counsel of its choosing to defend against such claims.
8. Limitation of Liability and Release of Claims
To the fullest extent permitted by applicable law, you hereby release Ridgepeak Capital, its officers, directors, employees, agents, affiliates, and service providers from any and all claims, causes of action, damages, losses, or liabilities arising from or relating to telephone calls or text messages received in connection with this Consent, including without limitation any claims based on alleged violations of the Telephone Consumer Protection Act (TCPA), the Truth in Caller ID Act, the Telemarketing Sales Rule, the Fair Debt Collection Practices Act (FDCPA), or any similar federal, state, or local laws, statutes, or regulations, as well as any tort or consumer protection claims.
9. Equipment and Service Requirements
You are solely responsible for obtaining and maintaining all devices, equipment, software, internet service, and wireless service necessary to receive telephone calls and text messages from Ridgepeak Capital. Text messaging services may not be available with all wireless carriers or on all device types. Ridgepeak Capital makes no representations or warranties regarding the availability, compatibility, or reliability of text messaging services on your device or through your carrier.
Wireless carriers are not liable for delayed or undelivered messages.
10. SMS/Text Message Program Terms
By opting in to Ridgepeak Capital's text messaging program, you authorize Ridgepeak Capital to send text messages to the mobile telephone number associated with your opt-in using automated technology or manual means. Messages may include transactional updates related to your account or application, as well as promotional or marketing content.
You confirm that you are the subscriber or authorized user of the mobile telephone number you provide at the time of opt-in.
After opting in, you may receive an initial welcome message or a confirmation message requesting you to verify your opt-in. This is in addition to the regular messages associated with the program.
You may cancel your participation in the text messaging program at any time by replying STOP to any message. After we receive your STOP request, we will send a final confirmation message. You will not receive further text messages from that number unless you opt in again.

Opting in to the text messaging program is not a condition of any purchase, application, or account registration.
11. Survival
Your obligations under this Consent — including, but not limited to, the indemnification, limitation of liability, and release of claims provisions — shall survive the termination of your account, the completion or withdrawal of any application, or the cessation of your relationship with Ridgepeak Capital.

13. Modifications
Ridgepeak Capital reserves the right to modify this Consent at any time. Changes will be effective upon posting the updated version on our website. Your continued use of our services or provision of your telephone number after any such modification constitutes your acceptance of the revised terms.
